Royal-Decree Law 16/2022. Domestic workers
Royal Decree-Law 16/2022, of 6 September, has been published to improve the working and Social Security conditions of persons working in domestic service.
We highlight the following points contained therein in relation to occupational risk prevention:
Article 1.
Amendment of Law 31/1995, of 8 November, on prevention of Occupational Risks. Law 31/1995, of 8 November, on Prevention of Occupational Risks, is amended as follows:
One. Se suprime el apartado 4 del artículo 3 (este hacía referencia a la exclusión del ámbito de aplicación de la LPRL del servicio del hogar familiar).
Two. Se añade una disposición adicional decimoctava, que tendrá la siguiente redacción:
"Additional provision eighteen. Protection of the occupational health and safety of persons working in domestic service. Persons working in domestic service are entitled to effective protection in terms of occupational health and safety, particularly in the area of prevention of violence against women, taking into account the specific characteristics of domestic work, in the terms and with the guarantees set forth in the regulations to ensure their health and safety."
First final provision.
The fifth additional provision of Law 31/1995, of 8 November, on Prevention of Occupational Risks is amended: -Fifth additional provision. State Foundation for the Prevention of Occupational Risks, FSP-.
