​Organic Law 10/2022, of 6 September, on the comprehensive guarantee of sexual freedom

Organic Law 10/2022, of 6 September, on the comprehensive guarantee of sexual freedom has been published. 

We highlight the following points contained therein in relation to occupational risk prevention: 

“Artículo 12. Prevención y sensibilización en el ámbito laboral. 

1. Las empresas deberán promover condiciones de trabajo que eviten la comisión de delitos y otras conductas contra la libertad sexual y la integridad moral en el trabajo, incidiendo especialmente en el acoso sexual y el acoso por razón de sexo, en los términos previstos en el artículo 48 de la Ley Orgánica 3/2007, de 22 de marzo, para la igualdad efectiva de mujeres y hombres, incluidos los cometidos en el ámbito digital. 

They must also devise specific procedures for their prevention and a channel for complaints or claims to be filed by parties who have been subjected to these behaviours, including specifically those suffered in the digital realm. 

2. Las empresas podrán establecer medidas que deberán negociarse con los representantes de las personas trabajadoras, tales como la elaboración y difusión de códigos de buenas prácticas, la realización de campañas informativas, protocolos de actuación o acciones de formación. The measures adopted, in accordance with the provisions of the previous paragraph, can apply to the entire workforce of the company, regardless of their type of employment contract, including persons on permanent seasonal contracts, fixed-term contracts and work experience contracts. It can also be applied to interns and volunteers. Similarly, parties rendering contracted services to the company can also benefit from the aforementioned measures. Companies will promote awareness and offer training for comprehensive protection against sexual violence to all staff in their service. Companies must include sexual violence among the occupational risks included in their risk assessment of the different posts held by employees and must train and inform their staff accordingly. 

3. Las empresas que adecúen su estructura y normas de funcionamiento a lo establecido en esta ley orgánica serán reconocidas con el distintivo de «Empresas por una sociedad libre de violencia de género». Should circumstances so require, the withdrawal of this distinction shall be assessed. 

4. Por real decreto se determinará el procedimiento y las condiciones para la concesión, revisión periódica y retirada del distintivo al que se refiere el apartado anterior, las facultades derivadas de su obtención y las condiciones de difusión institucional de las empresas que lo obtengan”. ​
